Responding to the Supreme Court’s
decision against the spiritual leader and author of more than 150
books, Anand Krishna, the son of Anand , Prashant Gangtani , said “The
decision of the Supreme Court is an erroneous decision!”
“We believe that under the
Constitution, Criminal Code section 244, an acquittal cannot be
appealed. There is no article in the Criminal Code which states that an
acquittal is classified into 2 categories namely pure acquittal and
impure acquittal. Corrupt people in the Supreme Court created those
distinctions. “Obeying an erroneous decision is the same as violating
the law” Prashant added.
Prashant also inquired about the
Attorney General’s promise he had made during a hearing in the
Commission III of the House of Representatives last year. On the
occasion, the Attorney General stated that acquittals which do not harm
the state’s money will not be appealed. He also asked about how the
Prosecutor could base her appeal on jurisprudence.
“In the first semester of a study at
the Faculty of Law, it is clearly taught that jurisprudence is used
when there is no law which regulates a certain case. In this particular
case it’s clear because there is the Article 244 of Criminal Procedure
Code. So if the Prosecutor uses jurisprudence for her appeal she
breaks the law, and there is also an obvious violation of law committed
by the Supreme Court itself. How people would obey the law if the
state’s highest legal institution also violates it, “Prashant said.
Regarding the content of the decision,
Prashant said there are many discrepancies between the facts and the
judgments of the Supreme Court which have been written in the verdict.
Dr. Muhammad A.S. Hikam, APU, the
former State Minister for Research and Technology during the National
Unity Cabinet of Gus Dur’s era, said in his Facebook account, “The
Supreme Court has published the decision of the appeal on its website, a
day after the lawyers of the plaintiff demanded that the Supreme Court
immediately executes its decision. It is very strange that a high
state institution like the Supreme Court succumbed to the pressure of
these lawyers.”
“Hopefully God the Almighty guides and
enlightens our leaders’s heart and mind God Almighty so that they don’t
perpetrate any evil and injustice. Amen.” It is the prayer and the
hope of AS Hikam for the law enforcement in Indonesia.
And then AS Hikam also states his
support to the struggle of Anand Krishna in his search for justice. “For
Mr. Anand Krishna, I will continuously support the struggle of Bapak
(Anand Krishna), the same as what I did to the late Gus Dur and to other
champions of democracy and human rights.
